Circular 132/2004/TT-BTC dated 30
December 2004 providing the new price list for all matter in the
field of industrial property
The Circular
shall take effect on 31 January 2005 and supersede the previous
one (Circular No.23TC/TCT dated 9 May 1997 issued by the
Ministry of Finance providing the provisions on cost and fees
for all matter in the field of industrial property).
The main changes:
(1)
Appling the same level of fees to all foreign applicant and
Vietnamese applicant, failure to distinguish between foreign
applicant and Vietnamese applicant in paying fees for all matter
in the field of industrial property.
(2)
With respect to
patent/utility solution:

Applying the same level of
fees for all independent claim, failure to distinguish between
the first independent claim and the next ones;

Fees for filling of
application, substantive examination of application, appraising,
assessing legal status on industrial property, searching,
maintaining validity of patent are counted per independent
claim, the said fees are direct proportion to the quantity of
independent claim.
(3)
With respect to industrial
design:
-
Fees for filling of
application, substantive examination of application, appraising,
assessing legal status on industrial property, searching,
maintaining validity of patent are counted per embodiment, the
said fees are direct proportion to the quantity of embodiment.
(4)
With respect to trademark:
-
If the quantity of
product/service of one class exceeds 06 (six) ones, the
applicant must pay an extra for the seventh product/service and
the next one;

The application of trademark
shall be published on the Industrial Property Gazette issued by
the NOIP and the applicant must pay for the publication
