The dossier for suspension of customs clearance
includes:
(i) Request
for suspension of customs clearance.
(ii)
Notarized Power of Attorney from the right holder (applicant) to
the representative (if any)
(iii)
Copy of protection title of the right holder or copy of
certificate of registration of IPR license (if the applicant is
the licensee)
(iv)
Initial evidences proving the import/export goods infringing IPR,
namely:
(a) IP subject matter (trademark or patent or industrial design)
(b) Name and address of importer/exporter
(c) Information of estimated time and place where import/export
procedure shall be taken place
(d) Detailed description or photo of goods suspected infringing
IPR
(e) Examination opinion of managerial body in respect with the
initial evidences.
(v) Payment
receipt of deposit of 20%
of the consignment value for suspension of customs clearance or
voucher of guarantee of a credit agency for the applicant to
compensate damages or cost incurred by such request
